1. Acceptance & Eligibility

By accessing or using our website or features (collectively, the “Services”), you confirm that you are at least 21 years old and legally capable of entering into binding agreements in your province or territory of residence. If you are using the Services on behalf of a company or organization, you represent that you have authority to bind that entity. If you do not meet these requirements, you must not use the Services.

2. Service Scope

Picks Lotto provides informational content, tools, and guidance related to lottery draws in Canada (e.g., formats, schedules, number selection interfaces). We may provide redirections to official provincial lottery retailers. We do not process payments, issue tickets, or conduct draws. Purchases, payments, and prize claims occur solely with the official provincial retailer and are governed by their terms and policies.

You are responsible for verifying all draw details, purchase confirmations, and results with official sources. Our content is provided for general information and planning purposes and may change over time.

3. Accounts & Security

• Registration: You may create an account to save preferences or use features. You agree to provide accurate information and keep it current.
• Credentials: Keep your login credentials confidential. You are responsible for activity under your account. Notify us promptly of suspected unauthorized use.
• Notices: We may contact you about important changes, security alerts, or service messages related to your account.

4. Acceptable Use & Conduct

When using the Services, you agree not to:

• violate any applicable law or regulation;
• interfere with or disrupt the integrity or performance of the Services;
• attempt to gain unauthorized access to accounts, systems, or data;
• crawl, scrape, or harvest content except as permitted by robots.txt or explicit written consent;
• upload or transmit malware, harmful code, or spam;
• impersonate others or misrepresent your affiliation;
• use the Services in a way that infringes intellectual property or privacy rights;

5. Content & Intellectual Property

The Services, including text, graphics, logos, icons, user interface, and software, are owned by or licensed to Picks Lotto and are protected by Canadian and international laws. Subject to these Terms, we grant you a limited, revocable, non-transferable, non-exclusive license to access and use the Services for personal, non-commercial use. No other rights are granted. Your interactions with retailers, including purchases and prize claims, are solely between you and the retailer. Review their terms and privacy notices before proceeding.

7. Disclaimers

The Services and all content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that defects will be corrected. Schedules, results, and draw information may change without notice; always confirm with official sources.

8. Limitation of Liability

To the maximum extent permitted by law, Picks Lotto and its directors, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the Services, even if advised of the possibility. Our aggregate liability for all claims relating to the Services is limited to the greater of (a) the amount you paid us (if any) for access to the Services in the 12 months before the claim, or (b) CAD $50.

9. Indemnity

You agree to defend, indemnify, and hold harmless Picks Lotto and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your violation of these Terms or your misuse of the Services.

10. Suspension & Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, pose a security or legal risk, or for operational reasons. Upon termination, sections intended to survive (e.g., ownership, disclaimers, limitation of liability, indemnity, governing law) will continue to apply.

11. Governing Law & Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles. You agree to the exclusive jurisdiction and venue of the courts located in Ontario, Canada, for any dispute arising from or relating to the Services or these Terms. If you reside in Québec, mandatory consumer protection provisions of Québec law also apply to you.

12. Changes to the Services & Terms

We may modify or discontinue parts of the Services at any time. We may update these Terms to reflect operational, legal, or regulatory changes. The “Effective date” at the top indicates the latest revision. If changes are material, we will provide reasonable notice (e.g., posting an update or sending an email to account holders).

13. General Provisions

• Entire agreement: These Terms, together with our Privacy Policy and any feature-specific terms, form the entire agreement between you and us regarding the Services.
• No waiver: Failure to enforce a provision is not a waiver of our right to do so later.
• Severability: If any provision is held invalid, the remaining provisions remain in full force and effect.
• Assignment: You may not assign these Terms without our consent. We may assign or transfer our rights in connection with a reorganization, merger, or sale of assets.
• Language: These Terms are available in English. A French version may be provided; in case of discrepancy, the English version prevails.
